01Scope and definitions
These terms concern services supplied by TMobility OÜ, an Estonian private limited company, under the translaze. brand. References to ‘we’, ‘us’ and ‘our’ mean TMobility OÜ; ‘you’ means the customer requesting or purchasing our services.
‘Services’ means the translation, certification, apostille or legalization work described in an agreed written quotation or order confirmation. ‘Source materials’ means the documents and instructions you supply. ‘Deliverables’ means the completed work specified in that agreement.
02Quotations and orders
A request for information or a quotation does not itself commit either party to an order. The scope, languages, destination country, certification requirements, delivery format, price and timetable should be set out in writing before work is authorised.
An order is confirmed when we accept it in writing. Any quotation validity period and payment conditions are those expressly stated in the quotation. A separately signed agreement takes precedence where it expressly varies these terms, subject to mandatory law.
If the documents or requirements differ materially from the information used for a quotation, we will explain any proposed change to price or timing and seek agreement before carrying out additional work.
03Your documents and instructions
Please provide complete, legible source materials and accurate instructions, including the receiving authority, country of use, spelling of names and any known submission requirements. You must be entitled to share the documents and authorise their use for the requested services.
A translation reproduces the content of the source; it does not establish the authenticity or legal validity of the original document. Missing pages, unclear text or late instructions may affect the scope and delivery timetable. We will raise issues that become apparent during the work.
04Translation, certification and official procedures
We will perform the agreed services with reasonable care and skill. Where a certified or sworn translation is required, the order should identify the applicable format and destination requirements.
Changes that would misrepresent the source text cannot be included in a certified translation. Name spellings, terminology and other clarification requests will be considered consistently with the source and the translator’s professional obligations.
Acceptance of documents remains a decision for the receiving authority. Apostilles, legalization and other official procedures may depend on third-party requirements and processing times. Translation and document coordination are not legal advice or a guarantee of a visa, permit or other application outcome. This does not remove responsibility for meeting the requirements we expressly agree to fulfil.
05Delivery and changes
The delivery method and any agreed deadline are specified in the order confirmation. Timing depends on receipt of the materials, instructions and any payment required under that order. We will notify you of a material delay and discuss the available options.
Additional documents, different certification requirements or amendments to the source may require a revised quotation. Changes to an existing order should be agreed in writing. Postal delivery and authority processing are subject to the arrangements disclosed for the particular order.
06Prices and payment
The agreed quotation or order confirmation states the price, currency, applicable taxes, delivery costs and any third-party fees. Payment methods and due dates must be disclosed before the order is confirmed.
No additional service or charge should be introduced without your agreement, except where mandatory law requires otherwise. Any proposed suspension for non-payment must be communicated to you and must respect applicable consumer rights.
07Cancellation and consumer rights
To request cancellation or a change, contact us as soon as possible. Any amount payable for work already carried out or non-recoverable third-party costs must be assessed under the agreed order and applicable law; cancellation does not automatically mean the full price is payable.
Consumers may have a statutory right to withdraw from a distance service contract, generally within 14 days of its conclusion. Where applicable, work during that period requires the consumer’s express request. If the consumer then withdraws, a proportionate payment may be due where the legal conditions are met. The right may end after full performance only where the required prior consent and acknowledgement have been obtained.
Mandatory rights concerning withdrawal, remedies, refunds and unfair contract terms remain unaffected. Specific cancellation information and any required consent must be supplied before the relevant order begins.
08Questions, corrections and complaints
Please review the delivered documents and tell us promptly about any suspected error, missing item or failure to meet the agreed specification. Include the order reference and the relevant text or receiving authority’s explanation so that we can investigate.
Where our work does not meet the agreed requirements, we will discuss an appropriate correction or other remedy in accordance with the contract and applicable law. Prompt reporting helps resolve issues but does not replace statutory complaint or limitation periods.
09Confidentiality and personal data
Documents and non-public information supplied for an order are to be used only to assess or perform the agreed services, administer the relationship or meet legal obligations. Access should be limited to those who need it, including translators, document-service providers and professional advisers involved in the order.
Personal data handling is addressed separately in our Privacy Policy. Where we process personal data on behalf of a business customer, the parties must establish their respective roles and any required data-processing agreement before that processing takes place.
10Rights in documents and deliverables
You retain your rights in the source materials and permit us and authorised service providers to use them to perform the order. You are responsible for obtaining permission where materials belong to someone else.
The agreed deliverables are supplied for the purpose stated in the order. Any particular ownership or licensing arrangements should be recorded in writing. Our pre-existing website content, branding, templates and tools do not become the customer’s property merely because services are purchased.
11Responsibility and events outside our control
Each party remains responsible for its obligations under the agreement and applicable law. These terms do not exclude liability that cannot lawfully be excluded, including mandatory consumer protections. No fixed liability cap is established by this draft.
If an event outside a party’s reasonable control prevents performance, that party should notify the other promptly, take reasonable steps to reduce its effects and discuss revised arrangements. Such an event does not remove any statutory right to cancel or obtain a remedy.
12Ending an order and general provisions
Where a material breach occurs, the affected party may request that it be remedied and exercise any right to suspend or terminate permitted by the agreement and applicable law. Ending an order does not remove rights or payment obligations that have already arisen lawfully.
Subcontracting does not remove our responsibility for the agreed services. Any transfer of an agreement must respect applicable law and the customer’s rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Updates to these terms apply to future orders; they do not retrospectively change an existing agreement without a lawful basis and any required agreement. No partnership or agency relationship is created simply by purchasing our services.
13Applicable law and disputes
This draft proposes Estonian law for the agreement, without depriving a consumer of mandatory protections that apply in their country of habitual residence. Court jurisdiction and any dispute-resolution arrangement must comply with applicable law, including consumer jurisdiction rules.
Please raise complaints with info@translaze.com so we can seek a practical resolution. These terms do not require customers to use a private arbitration scheme or prevent them from contacting a competent court or consumer authority.
